Exclusives

If I take a freelancer on as exclusive under my agency are they then considered an employee? I am not requiring them to work for me they are still independant contractors and can take any clients they want off of upwork.

Exclusive agency members can only work on contracts under the agency while the non-exclusive members have a choice of applying for jobs either under the agency or not. Payments from contracts exclusive members of the agency are hired on will always go to the agency account. Then the agency is responsible for withdrawing the funds and paying the members for the work they’ve done. Please check this help article for more information.
