Hiring and paying agency members on Upwork

Hello community,

 

I have gone through this article and others, but didn't find answer to my request. Is hiring new freelancers from upwork and paying them on Upwork is considered as an acceptable use?

 

The agency (not clients) is responsible for paying agency members. Payments from agencies to agency members are not protected or facilitated by Upwork.
How much the agency members are to be paid is determined by the agency and the agency members.
Agencies are responsible for maintaining proper tax records and worker classification. Agency members may be classified as either freelancers or employees of their agency. Please also see the Upwork User Agreement.

Hi Alaeddine,

 

Typically, agencies are teams of professionals that already know each other and work together outside of Upwork. When such companies bring their business on Upwork and would like to use the platform for work, they can add their team members to their Upwork agency.

In the case that I publish a job on Upwork intending to add the freelancer to my agency. How to stay compliant with Upwork terms?

From one side, the hire were via upwork so I am supposed to pay them in the contract (and can't tranfer only after paying a fee)

From another side, as agency the article above says that The agency  is responsible for paying agency members. (even outside upwork)
