Hi Samuel,

I can see that the disputes specialist has already reached out to you via the ticket. I have also shared with the team the message transcripts that you sent to me. Hopefully, everything gets resolved soon.

Hi samuel,

I had to edit your post because it is a violation of the Upwork Community Guidelines to share chat transcripts/conversations in the Community.

Could you please share with me, via a private message, where the freelancer actually said that they will not release the refund request until you change your feedback so that I can report this to the team for their review. As other community members has shared, feedback coercion, or pressure is a violation of the Upwork ToS.

I can also see that you have an open ticket with the team regarding your dispute. Please expect someone from the mediation team to get back to you via the ticket.

I would consider charging UpWork with gross negligence.

I go to the carnival; and there are signs that say: "You have to be at least this high / old / tall / smart, to get on this ride".

Apparently, there were no warning signs for this ride.

My question is Upfront will refund my upfront payment on fixed price project?

If the freelancer has withdrawn the money it is gone and there is no way Upwork can get back funds you voluntarily released (UNLESS they are still in the freelancer's Upwork account)

By not using the system the way it is designed you forfeited your Escrow protection and you have, to a degree, chosen not to be protected by the protection that is available to you.....

Yeah sadly i must accept that, wasting $100 for nothing. What can I say i've been fooled by doing it,

that will be my lesson for next hiring.

Gerry: I agree that it can be very easy for a new client to make big mistakes when using Upwork for the first time.

Especially when she is being manipulated by an unscrupulous freelancer.

I know Upwork has been trying to improve the ways it educates new user - both clients and freelancers. I hope that things will continue to improve for clients, so that they will encounter more warnings, like you suggest.

None of this negates the fact that the original poster paid a freelancer for nothing, and that money can't be retrieved.

I had to comment on something in the original post:

My hired freelancer ask me to do Upfront payment and guide me how to do that, and she asked me not to bother her for a week so she can focus doing the project.

As an Upwork old-timer I'm amazed a freelancer would make such a demand. I've had a client or 2 who would message me every 10 minutes or so and maybe I should have asked them to stop, but I didn't because it would seem rude. As far as communication is concerned, as long as a client responds promptly to my questions and comments, I have nothing more to ask for.

A freelancer will make such a demand knowing that after 5-6 days they can withdraw the money and vanish without there being anything the client or Upwork can do about it because the security hold is over...

well the problem is im not even finish explaining about my project, but she pretend like she already understand what i want to make. Yes I completely understand ur point not to bother every 10 minute, but i think it is fair if i want to ask once a day about the progress
