How refund from ended contract

It's my first time to be as a client. The experience is pretty frustrating.

I hired one freelancer by fixed price contract. He failed make it and ended the contract. But there is no obvious way to refund it. NOW the contract has budget and remaining money but no escrow.

What can I do?
