What if I don't have a patent pending? Am I protected?

 No.  Unless you sign some sort of legal document.  Even that is not full proof.  I believe there is an active lawsuit against Apple from Carnegie Mellon Prof. about the use of touch-slide or touch-pinch technology.  Even though Jobs signed NDA.
