Add a collaborator for my work

Good evening,
I have a question about adding a contributor to my profile.
I have a colleague who I would like to help me work on my projects,
I have a freelance account but he is not a member of Upwork. How can it be inserted?
Is it possible to do such a thing, or how could I fix it? Thanks in advance for your help Giorgia

Giorgia:
You can do anything you want on Upwork as long as you don't violate Upwork rules and use the functionality allowed by the user interface.

You already know that nobody other than yourself may ever log onto your Upwork account.

You already know that nobody other than yourself is allowed to know your password.

You may indeed work with a colleague.

If you are working on an hourly contract, then any client who hires you is also welcome to hire your colleague, using Upwork or NOT using Upwork.

Upwork does NOT prohibit people from working together, whether they are Upwork freelancers or not.

If you have been hired using a fixed-price contract, you are even allowed to sub-contract, meaning that you directly hire another freelancer. You may hire an Upwork freelancer or a non-Upwork freelancer. But if you sub-contract, you must notify the Upwork client you are working for.

You are not allowed to create a freelancer profile that represents somebody other than yourself. You are not allowed to create a freelancer profile that represents a pair of people, or a group of people.

Upwork DOES allow you to create an agency, if that is something you are interested in.

Thank you so much Preston for your comprehensive answer,

Could you tell me how is it possible to do what you tell me? It is not possible as a frellancer to create a team, or to invite this colleague to Upwork? I will absolutely not do anything that violates Upwork's rules, so I'm looking for the best way to do it without violating the terms and conditions.

Hi Giorgia,

An agency is a business that sells the services of multiple freelancers on Upwork. We've created a guide to agencies to help you decide if an agency is right for you. You can also check out this help article to learn more about agencies. To create an agency account on your existing account, please follow up instructions in this help article.

Feel free to reach back to us if you need any further assitance.

Thank you!

I'm pretty sure that's not true - but perhaps a moderator can confirm - you cannot refer clients to other freelancers who aren't on Upwork.

That is correct, Christine.

As per Section 7 or the User Agreement:

  • Refer a User you identified on the Site to a third-party who is not a User of the Site for purposes of making or receiving payments other than through the Site.

previously described case would be considered circumvention.

Thank you!

Yes, in fact I would not want to let the other person work outside of Upwork, in fact I was asking if there is a way to be able to access Upwork as part of my team, with their account.

Does that also apply for freelancers that have been turned down in the past?

Some jobs would violate the ToS if done on Upwork, would it also be considered circumvention if we refer clients to freelancers outside Upwork since they cannot be done through Upwork?

Hi Jennifer,

I won't be able to provide an answer if this question is about a hypothetical freelancer account or job. If you'd like to refer your Upwork client to a specific freelancer whose profile wasn't accepted on Upwork or refer them for a specific task that cannot be completed on Upwork, feel free to share more details about the situation with me via PM or with our support team via this page.

I am not asking hypothetical questions and I am sure there are more people wondering what the answers are.

1. Is it circumvention to link a client from Upwork with a freelancer outside Upwork that previously has been turned down?

2. If a clients wants me to translate a violent game, it would violate the ToS:

Seeking, offering, promoting, supporting, or endorsing services, content, or activities that:

  • are defamatory, illegal, violent, profane, vulgar, threatening, unlawfully discriminatory, illegal, pornographic, obscene, or sexually explicit in nature;

What are we allowed to do? Only tell the client to come back after 24 months to do the job outside Upwork?

Jennifer,

Based on what you've told us here, referring or moving a relationship outside of Upwork in both cases would be considered circumvention unless the conversion fee is paid or the relationship has been maintained on the platform for longer than 2 years.
