Client doesn't want to pay for second milestone

I started a contract of 200$

the contract was split into two milestones each 125$

pone for design and second php

I've done design and got paid 125$

then requested a second milestone and the client agreed on it

Then worked on PHP and delivered the work saying "all is good"

Client then refuses to pay for the second milestone to which they agreed claiming I said "all is good" meaning I don't want to get paid for the work I've done.

The contract is still going, and I want the mney for my work.

Can't file a dispute because client didnd't pay.

This is frustrating, we waste time and hard work and get treated like this.

Please help, I sent 2 requests to upwork support and got no reply.

I have all proof to support my claims.

That is fine.

Clients are not obligated to fund additional milestones.

 

Think of it like this:

A man went to a restaurant.
He ordered the spaghetti. The waitress asked, "Are you going to order dessert?"

The man said "yes."

Then he ate the spaghetti. He was full.

He didn't order dessert.

There's nothing wrong with that.

Um... Why did you do that? The second milestone was not funded.

You weren't supposed to do that.

The client did not fund the second milestone.

That means you were not supposed to work on the second milestone.

The client does not owe you any money.

That is correct. You can't file a dispute. Because you can only file a dispute if the client does not release escrow money to you. But ALL of the escrow money has ALREADY been released to you. There is nothing to dispute.

You used Upwork incorrectly.

The client is not obligated to reply to you.

You should NOT send requests to anybody.
You should not send requests to the client, and you shouldn't send requests to Upwork.

You do not need to send proof to anybody. I believe you that you used Upwork incorrectly.


I really am sorry if you are disappointed by how things turned out.
But you need to just let this go. This is over.

My advice to you is to close the contract and move forward. Learn from your mistakes here and don't make those same mistakes again in the future.

Unfourtnetly, if the milestone was not funded prior to the completion of the project, there isn't anything you can do to get that money. UpWork's TOS essentially says not to continue work or send completed work unless the contract is active and funded. 

 

Now, with that being said, you have to learn from this mistake and move on. There are a lot of scammers out there and a lot of people who would jump at not having to pay someone for their work. When working, especially on milestones, ensure that you get a notification that says it's been Activated and that the milestone has been Funded. Without those two factors, you should not complete any further work. 

 

I hope this doesn't set you back too much! I understand it can be frustrating and disheartening, but we all make mistakes. Make sure you have read the TOS, there is a lot of great information on there, and just keep on trucking!

Was the second milestone created and funded?
If so, submit the job with the "submit for payment" button (if you haven't already) and you'll automatically be paid in 14 days if the client doesn't dispute or ask for corrections.
If not, nothing to do. But tell the client that they can't use that part of the work since they haven't paid for it.
