Client unable to approve new milestone

Hi all,

I am in a fixed price contract with a client, however we realized the project would need to be broken into milestones after the contract had started. Therefore, I submitted a request to change the milestone, however it's been 2 days and my client is unable to see it or approve it. The work is complete on my end so I want to submit it so that the payment can be released. Do I send the file in a private message? Will he able to release the remainder of the payment even if the work is not attached as a milestone?

Hi Sarah,

 

I checked the contract I believe you're referring to and yes, the client will need to activate the milestone in order for you to request payment by submitting the work. I would advise against delivering the work via messages as Fixed-Price Protection requires that you submit your work via the milestone. If your client needs help responding to your milestone change request, they can find instructions on how to do it here. Feel free to also let them know they can reach out to us here and we'll be happy to help!

 

Alternatively, if there is no more work to be done on the contract the client should be able to close the contract and release payment while doing so.

Following up to my original post, the client is not responding to my messages anymore. All the work has been completed for the project and only requires submission. What should my next course of action be?

Andrea,

The client has now ended the contract and asked for a refund of the funds in escrow. I had received a reply in my ticket asking to give the client more time to respond. The client now claims I took too long when the task has been completed since Sunday and I just havent been able to submit it because he would not accept the milestone.

I'm not sure how I'm supposed to proceed henceforth as I'd like to be compensated for my time, effort and work done.

I'm sorry to hear that. I can see your client ended the contract and there is an Escrow Refund request. If you wish to dispute you can find instructions on how to file a dispute on an ended contract here. Please keep in mind you have 7 days to respond. After the dispute is filed our mediation team will assist you in coming to an agreement to resolve the issue. 

 

If you both are unable to agree in a reasonable period of time, the dispute specialist will make a non-binding recommendation. If that recommendation is rejected, the final option is to proceed to arbitration. See the Upwork Escrow Fixed-Price Instructions for more details, including the Escrow Dispute Assistance Policy.
