Dispute Related Question

Hello,

My client is not responding and I know if he did not respond I will win.  

 

I sent a message to my Dispute Specialist ("It's been 10 days since my ticket is created and the client did not respond, not even a single time") he said as mentioned in the initial email sent, the resolution time for a dispute is of 21 days, he will be sending him multiple warnings before making any final decision. 

My questions are 

1) Do I still need to wait for 21 days even if the client is not responding?

2) How many warnings he will be sending to the client before making the final judgement? 

3) Is there any way to make this process faster?

According to the rules, the dispute should have been closed and the funds released to the freelancer.

 

"Important: If a dispute is filed you must respond within 5 business days or the funds held in escrow will be released to the freelancer."

I have a dispute with client. I want to relaese escrew amount to the client. What should I have to do.

Do you actually have an official dispute or do you have a contract with a client where you are having a disagreement?

 

If it is the former, say so in the dispute mediation.

If it is the latter, simply close the contract, which sends the escrow funds back to the client.

HI Petra! 

Actually , I completed a Job and client sent me partial  milestone as bonus. That's why I placed a dispute with him. He just sent full amount as a Bonus. So, I want to rlease escrew amout to the client, as I have received my actuall acount now. Cotract has been already ended by Client. Thank you.

Who ended the contract? If you did, the money is already returned to the client. If the client did, you would have received a request to approve or dispute the return of the escrow funds? If you did dispute the return of the escrow funds, which initiates an official dispute, you just say that the matter is resolved in the dispute communication.

Dear Goran, can you please help me. I am receiving emails that I started dispute, but I did not. I paid the freelancer 10 dollars and it's all good, we are both happy. I dont want any refund. Can you please close this dispute? Please answer soon because I couldn't find any ways to write on a contact form to you. Thank you in advance! Kind regards

Please come back to the board and let us know how this was resolved for you: whether the client ever responded, how many days did the decision by the Upwork mediator require, what was the outcome for you?

I just got a notification that I have won the dispute because of non responsive client and money is successfully transfer into my account.

I just don't want him to think that I am teaching him the rules.

In my opinion: no.

 

We have already read about this before in the Forum. Other freelancers have reported that Upwork mediation specialists try to give clients more time to reply.

I completely disagree.

They give the client extra time until the freelancer pushes back. They have given the client time to reply. Ten days of time. Either there are rules, or there are no rules. And if rules apply to freelancers, rules have to apply to clients. Ten days is more than 5 business days. Enough already.

 

Zain, it is **YOUR** money you are disputing. Refer the mediation specialist to the article. 10 days means the client has been given plenty of extra time. Unless you stand up for yourself, nobody else will in a dispute, trust me on this one.

In my opinion: yes.

 

If a freelancer doesn't respond before a deadline like this, do mediators give them a 16-day extension and multiple warnings as well? Why not change the rule to give everyone 21 days if it's not actually a rule, just a guideline?
