Hi Margarete. I checked and both jobs have been taken down. You see the message about the jobs being private because you still have the link. The clients have been warned about the violations as well.

Thank you, Valeria. So "baby milk" and "baby formula" should be an alarm signal for the future. However, I think those guys will not give up and reappear some day...

While you concern is noted, you do understand, don't you, that Upwork Customer Support personnel are low-paid customer support contractors hired from all over the world? They could not possibly be expected to know about German baby formula smuggling or any number of arcane laws in nearly 200 countries, not to mention state, provincial, municipal laws, etc.

 

None of us could possibly know all laws everywhere.

 

Preston, I am sorry that those contractors are low-paid. I dislike such practices. They should be paid better, then they might be more motivated. Are my personal data safe if ill-paid contractors around the globe have access to them? I do not expect that everyone knows all laws everywhere but media reported across the baby milk topic around the world. It is affecting European countries as well as Australia and Hongkong.

 

There will always be a responsibility on the part of individual contractors to be selective about the jobs they choose and to avoid jobs which conflict with their own personal ethical standards or local laws or whatnot.

Yes However, there is also a responsibility of Upwork not to be a plattform for jobs that are obviously not legal and/or unethical. As soon as US laws are affected Upwork can have problems as well. The second job I have reported was about guns (sold by American and Israelian veterans) that have to be sold to German customers on Amazon, probabely they need a German to establish the store in Amazon. After having published it here the status has no changed to

 I can assure you that every job currently posted on Upwork is considered illegal or unethical somewhere, even the jobs you think couldn't possibly offend anybody's sensibilities.

Preston, I cannot believe this. If this were true, Upwork could close.

 

The fact that the German baby formula job is in conflict with Upwork ToS, due to it being a commission-only job, is sufficient cause for the job to be removed from Upwork. Even if the job presented a scenario that was completely legal everywhere, it shouldn't be on Upwork because it violates Upwork's ToS (Upwork's laws).

Exactly, but nowbody deleted that job, even after I have flagged it. That is why I published it here.

Your personal data will only be as safe as an US company may hold them safe, hence not on European standards. The content of e.g. files or texts will only be safe if you and your client encrypt them.  In some countries the use of encryption technology is illegal!

The job with the guns need not concern you. It is not our job to enforce German legislation all over the world. Even in some European countries selling and buying guns is legal. And, Amazon will enforce German gun laws. The recently removed potato guns/potato cannons from Amazon.de and some other European sites because these don't comply with lokal gun laws. IMHO it's not even Amazon's responsibilty seller and buyer have to take responsibility, not Amazon.

It may not even be the majority of jobs but many jobs really are illegal in some country or other. If the job is not illegal maybe the intent is illegal. Playing Poker for money is illegal in Germany, is it then illegal to translate a monthly newsletter for an online casino? IMO not.

In this case it seemed that the "client" looked for somebody from Germany helping them to open a store in Amazon probabely in the freelancer's name.

I listen to the news and read the news frequently every day. I certainly never heard of this story until it was posted here in the Forum.

I reported this earlier today, when there were 2 job posts, and now to my surprise there are 3 after I had already spoken to CS and I got a reply from Trust & Safety saying that they had taken appropriate actions but obviously they didn't remove the posts nor the client.

 

The CS agent told me that they can see if a client who was removed from the platform comes back creating a new account but obviously this either isn't true or they are not doing anything about it because I also keep flagging these posts and they just don't do anything until I file a complaint with CS.

 

The person from Trust & Safety said that I only needed to flag and that was enough, but I've experience that this isn't the case.

 

Today I got yet another invite for a job offering thousand of pounds a month and a requisite is to have an eBay account with positive feedback... I mean, I keep flagging these posts and they just keep appearing and inviting me.
