I worked for client named **Edited for Community Guidelines**, but now he is not paying

Hi all,

 

I worked for a upworks client named **Edited for Community Guidelines**, he is a registered client. I worked for him around 15 hrs now is not paying for that, alos when try to chan on skype , he disconnects from skype .

 

Please help how can i file against him.

Shyam I had the same thing happen to me around a 2 months ago.

to sum it up in one sentence

 

"if the project was set up hourly,upwork do not care"

even if you agreed the rate and amount of hours they will not help you.

 

I had to track the client myself through google, call him at work and threaten him.

Then he paid up.

 

you are on your own with this pal.

 

If the job was fixed price then upwork would help you.

 

even thought here is no difference

if you say 10 hours at $10 that is $100 (you are not covered against scammers)

if you say fixed price $100 (then you are covered by upwork)

silly I know

I am not making it up, that is what happened.

I contacted support and told them that the client had suspended his account

and not paid after I had sent him the files.

THEY TOLD ME, THEY WOULD NOT HELP.

FACT

 

So please dont come on here insinuating that I am lying.

Please refer to the information our team shared in the notification you received regarding your Hourly contract and in the subsequent tickets you created. Please check the resources our team shared on your tickets and the ones we posted here, in order to familiarize yourself with Upwork and the requirements for Hourly Payment Protection, which doesn't cover manual hours.

Shyam, please ignore every single word Steve said, it's all abject nonsense.

 

Let's find out what happened in your case:

 

  • Do you have an Upwork contract with the client? If you go to your My Jobs page, do you see a contract there?
  • If YES: Is it an hourly or a fixed rate contract?
  • If Hourly, did you use the tracker to track your time?
  • If Fixed rate, is it funded?

Could you answer those questions so we can figure out how to best advise you?

Upwork can only help (regardless of the amount whether it is $10 or $10,000) if a contract is fixed'rate and has been funded into escrow, or if a contract is hourly, and if the freelancer uses the tracker. Otherwise, it is true that a freelancer could be taking a risk.  This is stated very clearly in Upwork's Terms of Service.

Through Upwork?

obviously the job was hourly,

as I explained in the original post if it was fixed price I would not of had the problem.

 

I never time track and never will.

 Then don't claim that there is no protection for hourly work when you yourself choose not to avail yourself of the protection that is available.

 Other than misinformation, am I the only one that is a bit concerned about this?  You called him at work and threatened him?  No.  Just no.  I cannot possibly be the only one that finds that entirely disturbing.

I've checked and you were not hired by this client on Upwork. Please note that offering and accepting to be paid outside Upwork is a serious ToS violation. Please take screenshots of your conversations and report the client to Customer Support.

 

Please review these resources and specifically these safety tips before you continue submitting proposals.
