On a chargeback, the money was never in escrow. OK, it might have been there for two minutes, but it was never the thieves money to spend. Between the time the card is suspended and the freelancers finished their nonsense work for tens of thousands, the card owner reports it stolen and the bank shuts down all transactions related to that charge.There is no money, and Upwork is not going to give away money. The only time the freelancer will get paid is if they corrctly use the automatic time tracker, and then, Upwork is actually out the money.

Since this was fixed price contract you are not protected and will not be paid. Sorry this happened to you here.

But if the money was in escrow (as it would be if the freelancer did everything right), then wouldn't the freelancer be paid anyway, even if the client disappears?

That's terrible! I hate that Upwork allows that to happen. The contract should have already been "funded" so Upwork should have the funds to release to you regardless of what the client does.

That wouldn't matter. If the client got a chargeback, they would get the money back and if the freelancer would have to pay Upwork back if they had already withdrawn it before that.

It isn't Upwork. It is the owner's bank that issued the card. Upwork has no power. The change needs to come with the banks, who are well aware of the schemes, but since it doesn't hurt their bottom line, they do not care.
