Ownership of Artwork

1) Can the Upwork contract be customized to be a artist collaboration agreement? Is this allowed?

Or

2) Can the contract be customized in a way where the artist owns _% of work and rights and client owns _%?

All of these are purely theoretical at this point but may become relevant if I get a comic book artist job.

Are royalties allowed on upwork if they are written in to a custom contract?

In addition to the information Petra has shared, please refer to section 6.4 of the Optional Service Contract Terms which contains information about Intellectual Property Rights and Work Ownership.

1) It is "allowed" but would be entirely between the client and yourself and clients won't be used to this on Upwork and likely not necessarily go for that often.

 

2) You can create your own custom contract but the same applies as above.

 

As far as "royalties" are concerned, again, that is between you and the client and the above applies the same as to 1) and 2) above. Such royalties would also have to be paid through Upwork for at least 2 years.
