Historically, clients paid the 10% fee, which was evident in oDesk documents on the core site. Now, freelancers pay the 10% fee as evident in oDesk documents on the core site. In either case, freelancers' net earnings are the same. For US IRS tax related issues, see other threads throughout the Community.

Actually Ron, When I signed up for oDesk over 2 years ago the site terms always stated that the freelancer paid the fee. It was very clear that you paid a 10% fee for the use of the site. It just did not show in the freelancers earnings previously is why so many thought that Client paid the fee.

And we could get techical that the Client always has paid the fee as we are charging them a higher rate to offset the fee with oDesk, but we have always paid the fee. It is just how you want to look at it.

Ron,

I thought I would go get you previous oDesk terms. This is from wayback which keeps screenshots of sites.

2. ODESK GENERAL USER POLICIES

2.1 oDesk Fees.

oDesk charges Contractors a fee for services and technology including but not limited to maintaining the oDesk Platform and collecting amounts owed by Clients and remitting them to Contractors. Typically, this fee is equal to 10% of Client’s payments, plus a fee for withdrawals.
