Problem with a client. He does not want to pay.

Hello,

 

I have a problem with one of my clients. The last discussion with him happened a few weeks ago but I needed some time to think how to solve this and here I am writing you.

I've worked before with this client, the things were pretty weird in that situation also, because I've delivered some advanced drafts as we convened and it took him quite long to answer back, but finally we've finished the job and I've got payed.

 

In this case, it was also an architecture visualization project, we've divided it in 2 parts (draft and finals). I've sent him the drafts, he was quite happy with them (payed me for that phase) and after a while (after I've asked him about an answer a few times ) the feedback came.

The feedback was for some of the images (meaning that the rest were ok as he was really happy with the drafts) and he told me he will come up with some new drawings for the "kitchen" (he never did)also . I've made the changes he needed (acording to the feedback) and sent him. After that he never responded.

(The images were sent on 1st of June 2021 and I've asked him for an answer 4 times: on 18th of June, 29th of June, 9th of July, 26th of September). It was clear that he doesn't want to talk with me and somehow I've reached him on Facebook (I have the whole conversation and if needed I can provide some screenshots).

On Facebook we told me that he will pay, he apologized and said that he has some problems with his company, but he will pay. He told me that 2 or 3 times and asked me not to worry.

Again, a lot of time passed and I've told him that this is not cool and that I've waited enough and at this point he gave me the most weird answer: that the quality of the images was not good and that he didn't know how to tell me that. He insisted that he gave me some examples and I didn't reached the quality.

I've told him that this is not true, that he could have told me during the draft phase that something is wrong and I would have fixed the problems. I've also showed him a comparison between my final results and the images he gave me as an example and it was visible that the quality he received from me was higher than the one from his examples. I've also announced him that I will contact Upwork and he blocked me on Facebook.

 

My main mistake was that I haven't insisted to him to activate milestones so that we would have an escrow (however the whole conversation is on Upwork and I can send you and I can send you the facebook conversation also) and now I'm in a difficult situation.

I hope you could help me with some advice.

There is nothing to "contact Upwork" over.

Then this is over. There is nothing anyone can do and you're wasting your time and energy.

Close the contract, leave appropriate feedback and move on.

You will not get paid if you don't have an active milestone. Nothing upwork can do about that.
