Subcontracting

Hi. I'm currently in an hourly contract with a client but we want to bring in another freelancer for one task. The client wants me to handle this.. the job announcement and hiring. How do I do this without breaking rules? If we start a second contract with a fixed rate, can I hire someone with an hourly rate? Or do I have to hire fixed rate?

You are doing this for a client but you can hire any one from Upwork on your behalf..Hourly or fixed, doesnt matter..There isnt any voilation really but for further confirmation, you may contact Upwork support directly.

Thanks

You are not allowed to subcontract on an hourly job. ONLY on fixed rate contracts. So if you are hired on an hourly contract, you can't hire someone to do anything related to THAT contract.

You also need to remember that you will have to factor in two sets of Upwork charges, The client would pay you, then you pay the fee on that, then you hire a freelancer and that freelancer pays another fee.

Thanks for responding. The client is starting a second contract with me, fixed rate, so I can hire out to another freelancer for this task. I have one other question... Is there a way for all 3 of us to communicate on the Upwork platform?

re: "Is there a way for all 3 of us to communicate on the Upwork platform?"

Yes.

As a freelancer, there are many projects I work on which involve multiple Upwork freelancers.

Clients can invite any Upwork freelancer into a messanger "room" so that everybody can communicate in the same place.

The best way to do that would be for you to be an official hiring manager on behalf of the client.

Thanks for the 'Hiring Manager' idea, but I don't think the client will go for that. It's overkill.

Hi Sheryl,

Please, note that if the contract is hourly, another person won't be able to work on it and track time so you'll only be able to subcontract on fixed-price contracts. For more information about your responsibilities when subcontracting please see section 2.1 of the User Agreement and Optional Service Contract Terms.

Thanks, I understand. The client is starting a second contract with me, fixed rate, so I can hire out to another freelancer for this task.  Is there a way for all 3 of us to communicate on the Upwork platform?

Once I have a contract going with the sub-contractor, can I add the client to the room?
