Hi,

I just had a nightmare experience on UpWork plateform ....

the job poster turned out to be a scammer .. he used me for 24hours coding his python and pandas tasks ... once he received wht he looks for ... he said that he looks for better experience ... which is obviously the first excuse he could find to theft me 24 hours of non strop work....

He didn't stop there, once I debunked him by revewing his porfile, I got upset and contacted him through the app to tell him that I debunked him.

He went contacting upwork and allied with them to suspend my account. I have immediatly ported all these elements with the proofs i gathered to my attorney.

Today I filled the Lawsuit against upwork for using me and intentionnaly giving the job poster the abilty to theft me my energy and time. Upwork have protected a criminal thief and allied with him to theft

me by deception.

I was abled to prove it to my attorney and will prove it to the court.

Also I will conduct an aggressive compain to inform the american people about the corrupted practices of the Upwork corporates . you have no excuse this time ans I will meet you at the court.

The challenge that the job poster have posted was the actual job he needed to be done.

he used  us coders to develop his needs as if it was just a test..

how are we supposed to get protection from this people, when UpWork side the just because they are job posters, Upwork is a plateform that provide the job owners with a framework to bully and theft us coders..

this is the reason I am stepping in..

This job poster had no shame to theft me my work time and try to humiliate me at the same time ..

and Upwork provided him with all the means he needs to do it.

I am couting the days till we get to the court and will continue growing a resistence association against your corrupted practices that hurt our generations of young professionals.

By your reckless business strategies and total disrespect of the CSR you have inflected an imprecedented harms to the American society and you are a present threat to the people.

PS: I have contacted the company he claims he works for and they have insured my attorney that they have no job opening since at least 3 months which confirmed our initial suspicions. this Job poster is obviously a scammer and thief and needs to be ported to justice for his reckless unhuman scamming strategies.

And you at Upwork, you owe me a huge apologies, that I am not ready to easily accept.

May the lord help us to get ride of your kinds from our society

**Edited for Community Guidelines**  We don’t sue anybody. We only sue thief’s and
people with bad intentions that put their bad intentions and thefts by
deception in practice.
**Edited for Community Guidelines** The same way I already engaged the lawsuit and will
show you that here in California we have respect to owr people.
Good luck with your bad intentions Guru

Hi Adnane,

I'm sorry you've had a negative experience on Upwork. I'd like to clarify that Upwork offers Payment Protection, however, one of the requirements is having an official contract on Upwork. Once the client sends you an offer and you accept it, you'll have an official contract with the client that will be used to make payments and manage work.

I'd also like to clarify that Upwork users may be asked to verify their identities and information on their accounts. That's done to maintain trust on the marketplace. You can find more information about it in this help article as well as this support ticket you have with our team

Hi Upwork support,
I am glad to finally hear back from you.
Thank you for providing me with a rational response. I have read the entire
UpWork community guide before using it. And I am perfectly aware of the
escrow program as well of the non-eligibility of this case scenario to ask
for payment protection.
But, how I am supposed to be protected from clients with bad intentions
like this.
The truth is that I stopped what I was doing and focused on his job offer
from 6pm to 8am the day after (14 hours non stop) to deliver a perfect
outcome for his claimed coding challenge. I can’t let this go. I sincerely
can’t.
That is why I got upset and tried to contact him and tell him that I
debunked him and that he needs to pay me for my works or I will go after
him.
Today I found my UpWork account suspended while I am clearly the victim
here.
I immediately transferred this case to my attorney for review and have
conducted a small investigation on the company he claims have the job. It
turned out they have no job openings since 3 months and have no current
opening. The lady at the HR was nice to brief me after I honestly explained
my situation to her.
I have no issue with providing you with any needed ID document for
verification purposes.
This is just a formality.
But please first be fair with me by at least flagging the job owner.
You can’t let him do this again and again.
He took the code I made and said that he needs more experience ... let me
tell you that I now from this place challenge anyone here who can say I
have no experience. (Try me)
I am PhD in computational mathematics with a legacy from both parents
programmer analysts for more that 35years each. And my self start coding
at the age of 12.
Python is at least a 12 years success coding stories for me.
His argument of lack of experience with python and pandas was just
non-sense. The code I made was the most optimal solution using Pandas few
line of code... I even showed him math skills in this work that he can’t
afford to have. I have seen few of those in my career But never been
thefted or scammed by any of them, until now ... and I will not let him go
with it.
I will be covered my hours either the normal channels or by the court.
Simply because I pay my taxes and its my right to complain when I am hurt.

Sorry Adnane, but if I have not misunderstood, you did not have a contract in Upwork to do the job, is that correct?
Because if that's the case, I don't know what you're demanding from Upwork. If there is no contract, you cannot demand anything.
You made a mistake and the only thing you will get out of this is a "bad" experience. You will have to learn from it.

Unfortunately, you response is missing the most important part. The scam
occurred while the job was an activated proposal.
By saying that it was my mistake you deny the responsibility of UpWork on
hiding scammers in the platform. And you also deny the fact that I have
been victim to a scam in the UpWork platform.
A scam is a scam, wether it occurred during an active proposal or not.
Also, the coding online platform used to code the pre-hire challenge was a
link released in the messaging platform that UpWork dedicated to this job.
How I am supposed to be protected in this case? There’s no way for me to
know your client bad intentions and don’t give him the means to use me
without a signed contract.
Ps: in order to get a job you impose to us to disclose coding skills to the
hiring counterparts. And this is exactly the vulnerability of UpWork
business pipeline..
You job as a support should be to remote this informations to your business
intelligence teams so they can understand how deeply disturbing and
unlawful it is as a practice.

Again thank you for you time.
Respectfully,

So you agree there was no contract in place when you provided the client with your work?

I don’t understand what do you mean by contract in this case ??
For me the contract is automatically filled by UpWork and signed once you
the proposal is actif.
Anyhow supposing I admits that no contract was signed when the scam
occurred. What will be the action of UpWork to Protect me in the future
from clients requiring the completion of coding challenges. How to know
which one is a scam when UpWork is flagging it as verified and approved.
In both cases (contract or not) the scam occurred on UpWork coding platform
and the communications as well while the proposal was actif.
I personally will never use this platform after this ridiculous community
interaction.
I think I am in the wrong place talking the wrong people.
None of you is trying to help instead all of you responding trying to throw
responsibility off UpWork. Which is clear..
I consider that I have raised the issue enough to you. I can clearly state
that you are not going to help
and now it’s my time to do what I have to do.

Respectfully,

Upwork could not provide more information about how to best protect yourself from scammers and you have chosen to ignore all of it (or knowingly continued to complete work without any of the protection which the site provides).

Thanks for posting because, hopefully, others will learn exactly what they shouldn't do when using the patform.
