client close my contract and asked for refund :(

hello,
could you please help me,
i have been talking here before about a client who was angrey because when i finished her task i send it throw ' request payment ' and she wants me to send it throw messages and never do that either than she give permission for that!... i did what she wants on her first request and she started to send me more and more modifications " not modification because of personal mistakes on my drawings but it is basically plenty of small new requests we didn't agree for it before ) after that i decided to send documents on "request payment " and explained to her several times that sendìng payment request is the way to submit the drawings and you have time to revise it and i never refuse to make any modifications on my drawings if there is anything wrong.

she asked me about another task, and we agreed for every single detail on her task and after finishing the task i sent it to her throw the messages and told her to revise it to request payment, she asked me to give her some time after 2 days i asked her again if she revised the drawing or not...she didn't respond... and after 5 days i told her that i had been waited for 5 days and sorry i will send payment request and i waited one day after sending this msg....but she didn't respond so i had sent payment request.

today,she send 'changes request 'and wote "please don't do that i want my client to revise it " and on the same time she closed the contract and asked for refund!

i tried to talk to her and she started to say that my drawings is wrong! i asked her to show me the wrong parts but she didn't respond, every single reason she said i answered on it with prove from our conversation and from screenshots from the drawings i had sent to her....

what can i do know!... is filling dispute is the solution!...what happend when there is no way to solve this problem ,money will back to the client?? contract close and appear with 0$ on my profile!!..

Your client is not a client but a freelancer who farms out jobs she wins to cheaper freelancers. Such people are best avoided.

 

If you are sure you did the wortk according to the brief, dispute.


Sending the work in by submitting through the interface is the correct workflow. You are being taken advantage of.

 

The "client" has already left feedback, so whatever happens now, the effect on your profile is set in stone, you might as well fight for your money.

 

what i want is i don't wanna see closed contract with bad feedback and zero earning appear on it 😞 what i can do!

YM,

 

I concur with Petra 100%.

 

As a general rule, if your work is solid-

1. Do NOT refund any payments

2. Dispute whenever necessary.

 

Your client is amost certainly a fraudulent subcontractor and you've already spent your time on this work so, while this situation is unfortunate, refunding payment is NOT going to help you in this lose/lose dilemna.

0 paid contracts do not show on your profile, they do, however, affect your JSS (significantly)

When the client requested a refund you were given 2 choices: To agree to return the escrow funds, or to dispute.

 

How much money are we talking about here? Considering the damage (to your metrics) is done anyway, if the money in question is even remotely worth fighting for, or you believe that it's a matter of principle, go for the dispute.

 

If not, shrug your shoulders, tell the client that no part of the work can be used, and walk away.

to be honest, your JSS is so poor anyway at 56% it hardly matters.

If you are paid something the client's feedback is visible.

If you are not paid anything, no sign of the contract will be visible on your public profile, but the impact on your already dreadfully poor JSS will remain.

 

I think you need to learn how to choose clients, fast.

 

 

how i know that this client is a cheater!! it doesn't appear at first when we start the contract!!!
do you mean that my JSS will still as it is or will be less than that😳😭

That depends on the feedback the "client" left when closing the contract.

When the client requested a refund, as Petra said, you can click on accept that refund request or dispute that refund request. 

 

And, you don't win (or lose) a dispute. You are told by an Upwork mediator to try and work out some sort of agreement between the client and yourself. If that can't be done, then you go into arbitration and that costs money. $291 from the client and from you. In arbitration, that's where it's decided who is entitled to the funds in escrow. And that arbitration decision IS binding. 

 

Your JSS is so low that in your case, it really doesn't matter at this point what you do. The damage from this client and other clients have already been done.

you mean that upwork mediator didn't give decision!...didn't say which one is right!....
regarding the arbitration, what happend to the money if pne of us refused to pay for arbitration?

I'm sorry to learn about your experience, I would just like to clarify that mediation helps facilitate a mutual agreement between a client and freelancer in an event of a dispute. The Mediation Specialists are not a judge or arbitrator and there will be no “ruling” in anyone’s favor. Instead, the goal is to discuss the matter and work together to resolve any issues. You may read more about disputes here.

Regarding your question about arbitration, if one party pays for arbitration and the other does not, the dispute is found in the paying party’s favor. Escrow is released to the paying party and the arbitration fees are returned.

If she does not pay you for the work (or you agree to do the refund) the work you have done does not belong to her, it belongs to you.
She can't use it.

I don't know exactly how you can deal with this, but surely someone tells you how to get in touch with her and with what you can "threaten her" (I can't think of another word now Smiley Frustrated) so she won't use your work if she hasn't paid for it.
