Hiring a Contractor from China

I'm considering hiring a contractor who resides in China.  I just want to pay him as a usual contractor.  My understanding is that China's labor laws strongly encourage having a Chinese company and hiring employees rather than utilizing an independent contractor status.

Does utilizing Upwork for managing the employer / contractor payment and time management relieve me of any employer / tax situation with China?

I have hired Chinese freelancers on Upwork. I don't do ANYTHING differently. I don't care about Chinese labor laws, nor should you.

Hi Jared,

When you hire and pay your freelancer on Upwork, you actually pay Upwork Escrow Inc., which is our licensed escrow subsidiary and not the freelancer. The freelancer is responsible for filing or payin their own taxes. They can refer to a tax specialist for further understanding regarding their taxes. You may also find this link helpful.

Thank you!
