No, you are not an agency. You are a freelancer and if you HAVE an agency you can add that to your account later, after you have completed your freelancer profile and it was accepted, have added all your freelancers to your agency and paid for the agency plan.
But first you have to set up and complete your profile, see if it gets accepted, and then you can think about an agency.
Your account must be in your own, legal name as well, so you're off to a really bad start already.
