Tax question as an American with my business in France.

I am creating my account and I have reached the Tax Information part. I have my business registered in France and I am a US citizen. I pay taxes in France, as I live here 100% of the time. Can I work on Upwork and do I select a US person or Non US for my taxes?

I suggest you speak with a tax professional, rather than get advice from other freelancers.  (I believe that as a US citizen, you are required to pay US taxes no matter where you live.)

Please note that US-only jobs are available only for freelancers who are physically located in the US and can verify it.  Please consult yourself with a local specialist on how to report your earnings and taxes. 

You may still submit proposals to those jobs without US location requirements. Thank you.

I can't see why you can't work on Upwork if you are resident in France and pay French taxes. (At some point you will be asked to verify this.) You may have to consult a tax specialist to find out if you have to pay tax in the U.S. (double taxation). It depends on how your tax method is set up in France and what your business is. There is a special system for the "professions libérales", which includes freelancers, but that too has different sections.  

 

You would still have to pay tax on what you earn on Upwork to the French fisc. If you have a  French VAT number you can add this to your Upwork account so as not to pay VAT on Upwork's service  charge. Best thing would be to consult a local tax office if you are unsure.

I do have VAT number so I will use that.

If you live in France 100% of the time, there is renunciation paperwork you can fill out - very easily - so that you have zero legal U.S. tax burden.

Thanks! I've been reading up on it and it looks like the exemption
paperwork might be easy to do.
