What you and the client need to do is to come to some sort of compromise on some type of payment to you and some sort of refund to the client. If one of you has filed a dispute already, then that's what Upwork's mediator will tell you to do. If no sort of compromise can be made then the next step is arbitration. So, where is the freelancer right here? If the freelancer preformed professionally, did excellent work, delivered work that was completed fully and delivered (or fixed) work so the client received it without any errors, then if the freelancer wants to be paid, then the freelancer needs to go to arbitration. Because that's what arbitration is for. To determine who should receive the funds in escrow. The arbitrator's ruling is binding. So, if you want to get paid, instead of just letting the client sit there and receive a refund of all the money in escrow that the next step, is arbitration - and that's what a freelancer needs to do..

Nope, two more cases:
1. If you pay for arbitration and the client does not, the funds in Escrow go to you and the arbitration costs are returned to you.
2. If you AND the client pay the arbitration fee, the case goes to arbitration (and neither your nor your client's arbitration costs are refunded whatever the outcome.

good lord you gotta wonder what clients expect with that kind of JSS and the "writing." And I wonder how long until Upwork purges these accounts.
