client is not closing the second milestone

Hi,

I took an offer to prepare 30 interview questions on Tableau. I did it and sent to the client. Client approved the first milestone . (client's budget was $40 and I proposed $40). I was not aware that client had two milestones for that.

The second milestone is "client will check the questions if they are original"... He wants me to refund the excess money. I'm ready to refund the excess money if he ends the contract.

But he is asking me to refund the money without closing the second milestone... 

what should I do from here?
