Client Refuses to Pay

Hello everybody,

 

I recently got hired by **Edited for Community Guidelines**  to write viral articles. Because I did not like their environment I decided to leave. Despite telling me that my articles earned 8 dollars, they refuse to pay me. This was unfortunately done outside of Upwork in Skype, but I have evidence of what I am saying. NO PART of their ad said you would not get paid if you left by yourself. This is abuse and I am searching for my compensation.

We'll have the client's account reviewed for possible ToS violations. In order to follow Upwork ToS and benefit from Upwork Payment Protection, please make sure you don't do any work until you have an active contract on Upwork and the client's payment method is verified.

Hello Salvador, and welcome to Upwork.

 

I am sorry you had an unfortunate experience with a dishonest "client." (Actually, she was a scammer, and not a real client.)

 

It is really important that you undestand that you will not be paid for this work. Upwork will not help you get compensation for this work.

 

You used the Upwork system incorrectly. You violated one of the most important Upwork rules. You agreed to accept payment OUTSIDE of the Upwork system. You also worked without a contract.

 

You made MANY mistakes. But that's okay! I sense that you are a serious person who really wants to succeed here. You will learn from your mistakes and you will not make these same mistakes again.

The MOST IMPORTANT thing you can do right now is to purge yourself of any desire to be paid for that work.

 

Do not communicate with that "client" in any way. If you would like to report the client to Upwork Customer Support, you may do that. But do not say or do anything with Upwork that suggests that you want to get paid for the work that you did. Remember: Upwork can suspend your account or terminate it permanently for what you did. Be humble and 100% honest about what happened if you talk to Upwork about this.

 

One more bit of good news: Because you were not paid for them, the articles you wrote belong to you completely. You may post them in your portfolio or sell them or do whatever you want with them.

To my knowledge, I did not accept to receive payment outside of Upwork. The discussion took place outside of Upwork but I assumed I would get paid here.

 

I did not receive a contract but yes, I would like to report that client and just warn anyone hired by them.

Salvador, to help you out... I want to be REALLY clear about this:

 

What you did is considered an extremely bad violation of Upwork ToS. Don't mess around with that. Upwork HAS in the past suspended freelancers for just talking about getting paid off-platform. Upwork REALLY doesn't like this.

 

I do NOT THINK that you will face any kind of punishment from Upwork at all, because you are new, and because you came forth and talked about this on your own. And because you're being honest about it.

 

Your posts here should serve as sufficient notification to Upwork about this client. I would advise you to not waste any more time thinking about them. Don't go to Upwork Customer Service. If Forum moderators have any further questions about this, they will be able to ask you here, or via private messages.

 At no point and in no way did the OP say that payment outside the platform was even mentioned. Preston, you are making this up as you go along here. There was communication on Skype, but there was, as far as we know, no mention of payment outside the platform. Stop this scaremongering! Communication on Skype is not forbidden.

 

The OP did work without a contract which resulted in no payment. There is no "extremely bad violation of Upwork ToS" by the OP.

Would you talk to someone in a company and then go right from there and do work without getting hired? Upwork works the SAME way. If you work with a client without that client hiring you, (giving you an offer (which automatically results in a contract if you accept that offer) then you're not going to get paid.

 

It was said on here (I don't remember who said it) that some people learn by reading, And that would be reading Upworks TOS and the 1st message, in the New To Upwork (Getting Started). Those that do will know how to work on here, the procedures, and do's and don'ts. Others will learn by doing, And that would be just jumping in and apply for jobs without knowing anything. Sort of learn as you go. Most of the time, that doesn't work and the freelancer gets scammed, loses time and effort, goesn't get paid, or is out a lot of money by cashing checks and sending the surplus to someone.  It looks like you are the, "learn by jumping right in."

 

It's $8 which in the U.S. really isn't much. (3 1/4 gallons of gas)

 

you can message this client and let them know that since you weren't hired or paid for those articles the copyright belongs to you and if you find them published anywhere on the internet, you can contact the site's host provider  and have them taken down.

 

IMO I would just chalk this up as a learning experience. And learn from it.

Thanks for everybody else who answered too. Learned my lesson, nothing can be done and just want to spread the word of the scam.
