Firing freelancer mid contract - how much i have to pay?

Hello

A freelancer I hired for a month for 650$ hasn't done well and I want to end the contract.

He/she still has 2 weeks left and I made 2 milestones mid-month of 325$. If I end the contract now how much do I have to pay him/her 325 + extra days or full amount?

Thanks

Hi Filip,

Whether you want to pay your freelancer for incomplete work is up to you. When you end a fixed-price contract with remaining funds in escrow, you can request an escrow refund.

When you end the contract, you have the option to pay nothing or pay another amount. If your final payment is less than your escrow balance, an escrow refund request will be sent to your freelancer or agency. They will have seven days to respond.

If your freelancer accepts the refund request

If your freelancer approves the refund or does not respond within seven days, we will refund the money in escrow. Refund credits can take up to five business days to appear.

If your talent disputes the escrow refund

Your freelancer or agency can dispute the refund request. If this happens, we will notify you by email and you can either accept or reject their response:

  • If you accept the response, we will release the funds to the freelancer or agency.

  • If you reject the response, a dispute will be submitted and an Upwork mediation specialist will provide mediation assistance to both parties to try and resolve the dispute.

If you want to end the contract with a freelancer who still has two weeks left and you have already made two milestones of $325 each, the amount you owe the freelancer will depend on the terms you agreed upon in the contract.

Typically, when ending a contract early, you would pay the freelancer for the work they have completed up until that point. In this case, since you made two milestones of $325 each, it is reasonable to assume that you owe the freelancer for the work completed in those two weeks.

If the freelancer has not completed any work during the two weeks and you terminate the contract early, you may not need to make any additional payment. However, it is important to review the terms and conditions outlined in the contract you have with the freelancer.

If you are unsure about the specific terms and payment arrangements, it is recommended to refer to the contract agreement or reach out to the freelancer to discuss the situation and come to a mutual agreement regarding the payment for the work completed and the termination of the contract. Communication and transparency are key to resolving any contractual matters in a fair and professional manner.

It's also worth noting that if you encounter any difficulties in reaching an agreement or have concerns about the freelancer's performance, you can contact Upwork's customer support for guidance and assistance in resolving the situation.

Upwork doesn't want to talk to clients about a freelancer's performance.

Clients should learn how the buttons work and never need to contact Customer Support in order to manage their freelancers and projects.

Hi Filip,

In actual words, you are asking whether you should pay for the additional days of work the freelancer has done. It's up to you. If you're not satisfied with their performance, you can ask for a refund. Alternatively, if you're okay with the extra days of work, you can pay them. The decision is yours.

Kind regards,

Sanjay
