Hiring our own employee via upwork

I would like to hire someone who we already know and have experience with.

She does live abroad now and working with Upwork is for this moment a convenient way. However I don't want to be in breach when we hire her directly again in the future. If that's not possible, then I will have to look for another solution.

How can I make sure that this one person is treated differently in future contracts if things change.
