Dispute

Hello,

I would like to file a dispute on a contract that I am working on right now. I feel like I am being taken advantage of. The original contract that I wrote up got denied so I accepted his new one. The new offer asks for 22 articles of writing for a social media project. I have submitted the work to this guy several times and he keeps telling me what I am doing is wrong. He told me that what I submitted was wrong because of a format issue but everything else that I had submitted was okay. Upon fixing the format issue and submitting the work again he continues to tell me once again that there are several issues. I have not received any money yet towards any of the work that I have put in towrds the contract I can't add the word document to this I don't know if you guys are able to go into the messages and see the attached files to the documents that I have submitted to him.

Ashia. It sounds like a lot of grief for a small amount of money. Perhaps you should cut and run? If you are messaging written words like a Word doc, I would suggest creating lo res PNG files so they can't be copied and pasted without your approval.

Lastly, a bit of so-called wisdom. Never let other people decide how you feel.

For as many disputes as I've had, it's kinda funny but I don't know if you can trigger one. I used to keep submitting work to the milestone until the client got sick of it and filed for a refund. lol

You have to submit to the milestone. If it's funded, then it should be shown on the contract pagee. If it's not funded, then you can't dispute because there is no money in escrow.

There is money in escrow. I did submit the work and then he changed the contract after I submitted the work so I don't really know how all of that works. I'm still pretty new at all of this

Your client has no right to change your contract. If he did not verbalized correctly what he wanted it is not you fault, and he should own it and pay for his mistakes. Hope you have your whole conversation on Upwork interface, so you may dispute it.  Please mention the problem in your feed back for your client, adding "I hope he will learn from the experience."

He can't change the contract or the milestone after it starts. Whatever the funded milestone says is funded is what you will be paid, so it should be what you want for the deliverable. I assume you mean he asked for revisions. You can submit again after they trigger a revision request, but the client can keep doing this endlessly. I usually just keep submitting until they get mad and close the contract and ask for a refund, and that's when you can dispute. I don't know if a freelancer can trigger a dispute, and I've been in probably 10 of them. lol  I guess I just annoy them enough until they trigger one for me.

Okay. I think I understand what you're saying. Just to make sure though haha you're saying that he changed to mile marker not the contract and that i can't get a dispute until he has cancelled the contract?

You can initiate a dispute if the client requests endless revisions and refuses to release the milestone payment - this is copied from here

To file a dispute on an active contract

  1. Contact Upwork Customer Support
  2. Give details to support your claim that the work is complete and your payment is due. Explain the situation with enough information to help the dispute specialist understand your claim.
  3. Our customer service agent will open a case with one of our mediation specialists to review your situation.

okay thank you. I didnt know how all of this works. That is fine. Thank you for the suggestion.

How about addressing the - very serious - issue which Ashia has identified, rather than blaming the victim?
