In a normal situation, the freelancer owns the code, article, photo, etc. Once the client pays for the work, the client owns it. If the freelancer gives a refund, so the client hasn't paid anything, the freelancer owns it. With the oDesk guarantee system, if the client gets their money back, they shouldn't own the work because they didn't pay for it. But the freelancer received their money, so they shouldn't own it either. Technically, I guess oDesk owns every piece of work that clients refuse to pay for under the guarantee because oDesk is actually paying for it. I know that people don't like the refund system because people can hide feedback, but when refunds are made directly between client and contractor, it's clear who owns what.
