Question about (not sexual) Nudity in Video Project

I recently signed on with a client to edit a director's cut of an already made and distributed documentary. This documentary can be found in libraries, purchased on Itunes and has an IMDB page. I said yes prior to watching the documentary (because watching the documentary was part of the job), however I realized when watching through that there is minimal nudity (shots of women's breasts) within the documentary. It is not a sexual documentary, however I know that Upwork has serious guidelines around nudity and wanted to double-check that this is an okay project to work on. Thank you!

Upwork has no rules prohibiting you from working on the project you described. Whether or not you work on this is up to you.

First of all, there is no ban relating to what you are talking about. You may have read about rules prohibiting sexually explicit content being posted on Upwork, or jobs relating to such. That's not what you are referring to.

 

Second: If you respond to a job post that asks you to work with a documentary video, then you will be doing all of that work outside of the Upwork platform. So you are not going to get banned because Upwork has no way to even know about it.

 

Let's discuss a very specific example:

Imagine an Upwork employee - for some strange reason - added the following sentence to an obscure Upwork rules document somewhere, a document that you haven't read, but which technically speaking establishes a new rule:

"Upwork freelancers may not do any work involving documentary videos that were filmed in Bellevue, Nebraska."


So... That's a rule.

And then you are hired to work with a documentary video, and you're watching that video, and at the 15-minute timepoint, there is a 5-second scene that was filmed in Bellevue, Nebraska.


This is NOT GOOD. This is a violation of an Upwork rule, no question about it. At that point, you may choose to report this to Upwork. But if you don't report this to Upwork, how would they know? You wouldn't need to worry about getting banned.

So let me be clear: I am NOT TELLING YOU to violate any Upwork rules. I'm just pointing the practical mechanics associated with your question.

 

To further help you out, this may be the Upwork rule that you were thinking of:

You can’t offer, share, support or try to find anything that:

...is sexually explicit or related to sex work or escort services"

 

Based on your description of the job, I don't believe it violates this or any other Upwork rule.

Adult content. Creating or supporting sexually explicit or pornographic content, including erotic writing."

 

The "What kind of jobs aren't allowed on Upwork?" page does not mention nudity. It does not mention women's breasts. I completely support ANYONE who has a personal stance against working on a documentary video that contains exposed breasts. But that would be a personal decision that lies outside of Upwork's stated rules.

 

Similarly, I support anyone who, for personal reasons, will not work on a documentary video that depicts cooking using animal meat. Or a video that proclaims the superiority of cats as a pet, compared to dogs. I don't say these things to belittle legitimate concerns. I mention these examples to clarify the distinction between personal rules versus Upwork rules.
