client asked me to sign two contracts and send my identification card, is this legal

i have a client that interviewed me and i got accepted to the job then he asked me to sign a contract and sign Non disclosure agreement also send my identification card,  is it legal as i don't feel it's right to do that as we can have our contract through Upwork and that will guarantee him all he needs to know about the work and me, am i right so can anyone help me and let me know if i can sign these contracts or not.

We want to avoid using the word "legal" in this context. That can be confusing, because we want to reserve that word to refer to things that pertain to governmental bodies such as nations, states, cities, etc.

 

In this context, we want to use the word "allowed."

Or we can ask if something is a "violation of Upwork ToS."

 

Did the client violate Upwork ToS?

No.

 

Are clients allowed to ask you to sign an external contract?

Yes.

 

Are clients allowed to ask to see your ID?

Yes.

It is pretty common, and not a big deal if it's a real NDA, and not a document that sneaks weird stuff in.

This is a very unusual request.

 

Typically I would tell the client:

"Upwork has verified by ID and has all of that information on file. I authorize you to check with them if you have questions about my identity or verifications."

This has nothing to do with laws or legality.

 

It is perfectly legal for the client to request it.

It is also perfectly fine for you to decline.

 

If you want to sign those contracts, you can. If you don't want to sign them, don't sign them.

 

The client is free to decide to only hire people who sign the contracts.

I personally wouldn't send my ID card to just any prospective client, but have done so for a $100k plus contract with a top Enterprise client.

 

Ultimately, it's up to you.
